This User Agreement applies to you and BIKA. Throughout the site, the terms “we”, “us” and “our” refer to BIKA. As a precondition for using the Services, you must agree to this User Agreement. If you accept these User Agreement, you represent that you are age 13 or older. If you are between the ages of 13 and 17 or otherwise do not have the authority to enter into agreements such as these User Agreement, you represent that your legal guardian, or a holder of parental responsibility, has reviewed and agreed to these User Agreement.
By using or otherwise accessing the Services, you agree to these User Agreement. If you do not agree to these User Agreement, you may not use or otherwise access the Services.
Unless otherwise specified by a component of an applicable Service, the Services are free to use or download but may contain features that may allow you to make purchases within the Services.
1.1 Users may be permitted to upload, post or otherwise make available content through the Services including, without limitation, any text, photographs, user videos, and audio-visual works (“UGC”). Users may. also combine and intersperse UGC generated by. more than one user to produce collaborative UGC. Users may also overlay music, graphics, stickers, virtual items and other elements provided by us onto this UGC and transmit this UGC through the Services. The information and materials in the UGC have not been verified or approved by us. The views expressed by other users on the Services do not represent our views or values.
1.2 Whenever you access or use a feature that allows you to upload or transmit UGC through the Services, or to make contact with other users of the Services, you must comply with the terms and conditions of the Agreement. You may also choose to upload or transmit vour UGC on sites or platforms hosted by third parties. If you decide to do this, you must comply with their content guidelines as well as with the terms and conditions of the Agreement. You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
1.3 Any UGC will be considered non-confidential and you must not post any UGC on or through the Services or transmit to us any UGC that you consider to be confidential or proprietary. When you submit UGC through the Services, you agree and represent that you own that UGC, or you have received all necessary permissions, clearances from, or are authorized by the owner of any part of the content to submit it to the Services, to transmit it from the Services to other third party platforms, and/or adopt any third party content.
1.4 You or the owner of your UGC still own the copyright in UGC sent to us, but by submitting UGC via the Services, you hereby grant us an unconditional irrevocable, non-exclusive, royaltyfree, fully transferable, perpetual worldwide licence to use, modify, adapt, reproduce, make derivative works of, publish and/or transmit, and/or distribute and to authorise other users of the Services and other third-parties to view, access, use, download, modify, adapt, reproduce, make derivative works of, publish and/or transmit your UGC in any format and on any platform. You further grant us a royaltyfree license to use your user name, image, voice, and likeness to identify you as the source of any of your UGC.
1.5 By_posting UGC to or through the Services, you waive any rights to prior inspection or approval of any marketing or promotional materials related to such UGC. You also waive any and all rights of privacy, publicity, or any other rights of a similar nature in connection with your UGC, or any portion thereof. To the extent any moral rights are not transferable or assignable, you hereby waive and agree never to assert any and all moral rights, or to support, maintain or permit any action based on any moral rights that you may have in or with respect to any UGC you Post to or through the Services.
When you submit, upload, transmit or display any data, information, photograph or other content in connection with your use of BIKA ("Your Content"), you understand and agree that:
you will continue to own and be responsible for Your Content;
we will not sell Your Content to any third party;
Your Content will be shared with other users of BIKA in many ways. For example, Your Content will be seen by other users of BIKA once you have uploaded Your Content to BIKA;
you are giving us and our affiliate companies the right to use Your Content (with no fees or charges payable by us to you) solely for the purposes of providing, promoting, developing and trying to improve BIKA and our other services, including new services that we may provide in the future;
in using Your Content for these purposes, we and our affiliate companies may copy, reproduce, host, store, process, adapt, modify, translate, perform, distribute and publish Your Content worldwide by all distribution methods, including those that are developed in the future;
we may share Your Content with third parties that we work with to help provide, promote, develop and improve BIKA, but these third parties (other than our affiliate companies) will not make any separate use of Your Content for their own purposes (i.e. for any purposes that are not related to BIKA);
we may use the name that you submit in connection with Your Content (whether that be your account name, real name or otherwise); and you will comply with these Terms in your submission of Your Content.
You are prohibited from posting and agree not to post any prohibited content as determined by company, in its sole discretion and which includes, without limitation: Sexually Explicit Material, Violence and Bullying, Hate Speech, Sensitive Events, Unlawful Activity, IP Infringement.
In addition, you agree that we and our affiliate companies (subject to these Terms, our BIKA Privacy Policyand applicable laws and regulations): are allowed to retain and continue to use Your Content after you stop using BIKA – for example, where you have shared Your Content with other users of BIKA; may be required to retain or disclose Your Content in order to: (i) comply with applicable laws or regulations; (ii) comply with a court order, subpoena or other legal process; or (iii) respond to a lawful request by a government authority, law enforcement agency or similar body (whether situated in your jurisdiction or elsewhere); and may need to retain or disclose Your Content in order to enforce these Terms, protect our rights, property or safety, or the rights, property or safety of our affiliate companies or other users of BIKA.
You understand that even if you seek to delete Your Content from BIKA, it may as a technical and administrative matter take some time or not be possible to achieve this – for example, we may not be able to prevent any third party from storing or using any of Your Content that you have made public via BIKA.
We reserve the right to block or remove Your Content for any reason, including as is in our opinion appropriate or as required by applicable laws and regulations.
You are solely responsible for Your Content and we recommend that you keep a back-up copy of it at all times.
You must at all times ensure that: (i) you have the rights required to submit, transmit or display Your Content, and to grant us the rights as set out in these Terms; and (ii) Your Content (and our use of Your Content in accordance with these Terms) does not infringe or violate the rights of any person or otherwise contravene any applicable laws or regulations.
BIKA is not a storage service. You agree that we have no obligation to store, maintain or provide you a copy of any content or information that you or others provide, except to the extent required by applicable law and as noted in BIKA Privacy Policy.
3.1 For certain features of the Services, we may require you to register with BIKA and create an account in order to use our Software or Services, or any portion thereof. When you create an account, you will be asked to provide certain information, which may involve: (a) registering a unique username and password; (b) providing contact information, such as your name, phone number, and email address; (c) payment and billing information; and (d) any other information we request. Please note that you may only register for a single account and you may not use or access our Services with multiple accounts.
3.2 You are solely responsible for keeping your account information secure. Please do not share your account information with anyone and notify us immediately as detailed in the "Contact us" section. if you have lost control of your account information or you suspect there is unauthorized or suspicious activity in your account. You remain fully liable for any actions taken in respect to your account, regardless of whether these actions were taken by you or an unauthorized third party that has gained access to your account.
3.3 As the holder of your account, you are solely responsible for complying with these Terms of Use, and only you are entitled to all benefits accruing thereto. You may not allow any other person to (i) access your account; or (ii) access the Software or Services through your account. You understand and acknowledge that your account is strictly personal and may not be transferred to any other person or account.
3.4 We reserve the right to verify your registration details, such as name, address, age, and payment methods used, at any time, by requesting certain documents. These documents shall typically include an identity card, proof of address such as a utility bill, and proof of your payment method. If deemed necessary, we may request that the said document copies are notarized, meaning that the documents are stamped and attested by a public notary. In the event our requests for documents are not completed by you, BIKA may at its sole discretion terminate your account, and withhold any funds or virtual items (including Virtual Gifts and Diamonds, as defined below) that are present therein.
3.5 You agree to update any provided information or data or to provide additional items as part of ongoing efforts to prevent money laundering and illegal and fraudulent activities, and/or to comply with any other policies or protocols we elect to put in place. You agree that all information and data that you provide to us either at the time you register for an account or at any subsequent time will be truthful, accurate and verifiable in all respects and, by providing such information and data, you consent to us submitting it to third party providers such as age verification and identification services to verify your account.
3.6 We reserve the right at any time to investigate your account, including performing background checks and credit checks, in order to ensure compliance with these Terms of Use and our obligations and to ensure that no improper or illegal activity is or has taken place. In the event that we determine that your account has been involved in any illegal, fraudulent or improper activity, we reserve the right to terminate immediately your account without notice or liability.
Your use this app must comply with these policies:
4.1 Nudity and sexually explicit material. We don't allow nudity, sexually explicit material, or content that directs traffic to pornography sites.
4.2 Harassment or violent behavior. We don't allow behavior that harasses, threatens, or bullies app users or anyone else. Harassment can take many forms including stalking, repetitive pestering of a targeted individual, profanity, and unwanted sexualization. Additionally, do not allow depictions of graphic or gratuitous violence.
4.3 Hate speech. We don't allow the promotion of hatred toward groups of people based on their race, ethnic origin or nationality, religion, disability, gender, age, veteran status, sexual orientation, gender identity, or affiliation with any other protected group.
4.4 Spam. Don’t spam the app or create topics or posts with spammy content, including content or URLs that are promotional or commercial in nature, repetitive, unrelated, or excessive.
4.5 Child exploitation content. We don’t allow content that exploits or abuses children. This includes all child sexual abuse imagery (even cartoon images) and all content that presents children in a sexual manner. We will remove such content and take appropriate action, which may include disabling accounts and reporting it to appropriate authorities.
4.6 Illegal activities. Keep it legal. Don’t engage in illegal activities, promote dangerous and illegal acts, or depict illegal activity. This includes content that facilitates the promotion or sale of illegal drugs or recruits or fundraises on behalf of violent extremist groups. We also don’t allow the promotion of regulated products or services, including alcohol, gambling, and pharmaceuticals.
4.7 User Profile. Your photo, display name, tagline, bio, and associated website must comply with these policies. Additionally, we don’t allow photos, display names, taglines, bios, or links that contain profanity, lewdness, racial slurs, or gibberish.
NOTE：
Reporting Abuse and Consequences: If you find posts content that violates this policy, please report it. If you've found multiple videos or comments that you would like to report, you can report this ID. In response to a report of abuse or as part of our other review processes, we may review content in the aps and take action if it violates these policies, including removing the content, and limiting or terminating a user’s ID.
